Welcome to TutorOS! These Terms of Service ("Terms") govern your use of our website and services operated by Sorenax UG (haftungsbeschränkt). By accessing or using TutorOS, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, logging in, or using any part of the TutorOS platform, you signify your agreement to these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Description of Service

TutorOS is an AI-powered educational platform that enables teachers to create lessons, assignments, and assessments, and allows students to engage with educational content. The platform includes AI-assisted features for content generation, feedback, and personalized learning experiences.

3. User Accounts and Eligibility

3.1 Account Types

TutorOS offers two types of user accounts:

  • Teacher Accounts: For educators who create and manage educational content, classes, and student assignments.
  • Student Accounts: For learners who access assigned content and participate in educational activities.

3.2 Age Requirements

Teachers: Must be at least 18 years of age.

Students: Must be at least 16 years of age to create an account independently. Students under 16 may only use TutorOS if:

  • Their account is created and managed by a parent, legal guardian, or educational institution; and
  • The parent, guardian, or institution has obtained appropriate parental consent as required by applicable law (including GDPR).

Educational institutions using TutorOS with students under 16 are responsible for obtaining and documenting parental consent in accordance with their local laws and institutional policies.

3.3 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it promptly if any changes occur.

4. Terms for Teachers

4.1 Content Creation

As a teacher using TutorOS, you agree to:

  • Create educational content that is accurate, appropriate, and lawful.
  • Ensure that any materials you upload do not infringe on third-party intellectual property rights.
  • Take responsibility for the educational content you create and share with students.
  • Review and verify AI-generated content before sharing it with students.

4.2 Student Data Access

Teachers have access to student names, email addresses, and educational progress data for students in their classes. Teachers agree to use this information solely for educational purposes and in compliance with applicable data protection laws.

4.3 Content Ownership

You retain ownership of original educational content you create on TutorOS. By uploading content, you grant TutorOS a non-exclusive license to store, display, and transmit your content as necessary to provide the service.

5. Terms for Students

5.1 Data Sharing Consent

By creating a student account and joining a class or institution, you understand and agree that:

  • Your name and email address will be visible to teachers of classes you join and administrators of institutions you are associated with.
  • Your assignment submissions, quiz responses, and educational progress will be accessible to your teachers for assessment and feedback purposes.
  • Aggregated and anonymized data may be used by institutions for educational analytics.

5.2 Academic Integrity

Students agree to:

  • Complete assignments and assessments honestly and independently unless otherwise instructed.
  • Not share account credentials or allow others to complete work on their behalf.
  • Use AI assistance features only as permitted by their teacher or institution.

6. AI-Generated Content

TutorOS uses artificial intelligence to assist with content generation, feedback, and personalized learning. Regarding AI-generated content:

  • AI-generated content is provided as an educational aid and should be reviewed for accuracy before use.
  • TutorOS does not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose.
  • Teachers are responsible for reviewing and approving AI-generated content before sharing it with students.
  • Users should not rely solely on AI-generated content for critical educational decisions.

7. User Conduct

You agree to use TutorOS only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of TutorOS by any third party. Prohibited conduct includes, but is not limited to:

  • Engaging in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Uploading, posting, emailing, or otherwise transmitting any content that you do not have a right to transmit under any law or contractual relationship.
  • Interfering with or disrupting the operation of TutorOS or the servers or networks connected to TutorOS.
  • Attempting to gain unauthorized access to any portion of TutorOS or any other systems or networks.
  • Using TutorOS to transmit any unsolicited commercial communications or spam.

8. Intellectual Property

All content on TutorOS, including text, graphics, logos, images, and software, is the property of TutorOS (Sorenax UG) or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any TutorOS platform content without our express written permission.

User-generated content (lessons, assignments, etc.) remains the intellectual property of the creating user, subject to the license granted to TutorOS for service operation.

9. Data Protection and Privacy

Your use of TutorOS is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

Key data protection points:

  • You have the right to access, correct, delete, and port your personal data.
  • You can withdraw consent for data processing at any time.
  • We process data based on legitimate interests for service provision, consent where required, and contractual necessity.

10. Changes to Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any significant changes by posting the new Terms on our website or through email notification. Your continued use of TutorOS after such modifications constitutes your acceptance of the revised Terms.

11. Disclaimer of Warranties

TutorOS is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that TutorOS will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee the accuracy of AI-generated content or educational outcomes from using our platform.

12. Limitation of Liability

To the fullest extent permitted by applicable law, TutorOS (Sorenax UG) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the services;
  • Any conduct or content of any third party on the services;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • Any AI-generated content or recommendations provided by the platform.

13. Termination

We may terminate or suspend your account and access to TutorOS immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use TutorOS will immediately cease. You may request export of your data before account termination in accordance with GDPR data portability rights.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of TutorOS shall be subject to the exclusive jurisdiction of the courts of Bonn, Germany.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
